The NLRB recently finalized a new rule that will require all employers covered by the National Labor Relations Act to post a notice in their workplace notifying their employees of their rights to unionize. Many Members have inquired as to their ability to post a supplemental notice that informs employees of their right not to unionize as well. You should note that this supplemental notice is not a substitute for the NLRB notice, but only an optional supplement to that notice. A legal challenge to the NLRB’s requirement is currently being filed by the Coalition for a Democratic Workplace in which ABC Eastern Pennsylvania Chapter has joined. ABC National will also likely file an amicus brief in the case. The earliest this requirement will go into effect is April 30, 2012.
